Terms of Service

1. The service

IncreasinglyAwake (“the Service”) offers two kinds of monitoring. A “cron monitor” gives you a unique URL that your scheduled job calls when it completes; if a call doesn't arrive within the expected window, we email the account associated with that monitor. A “certificate monitor” periodically connects to a domain you specify to check its TLS certificate's expiry date, and emails you before (or when) it lapses.

2. Accounts

You need an account to use the Service. You're responsible for keeping your login credentials secure and for all activity under your account. Tell us if you believe your account has been compromised.

3. Plans, billing, and cancellation

The free plan is limited to a set number of monitors. Paid plans are billed monthly in advance through Stripe, our payment processor; we don't store your card details ourselves. You can cancel a paid subscription at any time from the billing page — your plan remains active until the end of the billing period you've already paid for, then reverts to the free plan. We don't offer refunds for partial billing periods except where required by law.

4. No guaranteed uptime or delivery

The Service is provided on a best-effort basis. We do not guarantee that check-in monitoring will run at a precise interval, that alert emails will be delivered promptly (or at all — email delivery depends on third-party providers outside our control), or that the Service will be free of downtime or bugs. Don't use IncreasinglyAwake as your only safeguard against a critical failure; for anything where a missed or delayed alert would cause serious harm, use additional or redundant monitoring.

5. Acceptable use

Don't use the Service to send abusive, fraudulent, or illegal content through the ping/alert mechanism, to probe, scan, or attack systems you don't own or don't have permission to monitor (including via certificate monitors pointed at third-party domains), or to try to circumvent plan limits or the Service's security. We can suspend or terminate accounts that violate this.

6. Limitation of liability

To the maximum extent permitted by law, IncreasinglyAwake and its operator are not liable for any indirect, incidental, or consequential damages arising from your use of (or inability to use) the Service, including damages resulting from a missed, late, or undelivered alert. The Service is offered as-is, without warranties of any kind. Nothing in these terms excludes liability that can't lawfully be excluded, including under the Australian Consumer Law.

7. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a security or legal risk to the Service or other users.

8. Changes to these terms

We may update these terms as the Service changes. Material changes will be reflected by an updated “Last updated” date on this page.

9. Governing law

These terms are governed by the laws of Western Australia, Australia.
